In 2003, the Texas Legislature passed the most restrictive legislation in the nation regarding medical malpractice. It has become virtually impossible to sue negligent physicians, hospitals, and nursing homes.  This is because the cap of $250,000.00 for non-economic damages, such as disfigurement, pain and suffering, loss of consortium, and mental anguish, prevents attorneys from funding these cases on a contingency fee basis.  The average medical malpractice lawsuit costs approximately $50,000.00 to $75,000.00 in order to pay expert fees, prepare demonstrative evidence, organize medical records, and depose treating physicians.  After fees of thirty-three and a third (33 1/3%), plus expenses, there is virtually no recovery for the victim.
