How do we get paid?
If we are able to settle your case, or get a verdict in court, we receive one third (1/3) of any recovery, plus any expenses that we have incurred as a result of prosecuting your claim. The bottom line: if we win, we get paid; if we don't, we receive nothing. It will cost you absolutely no out of pocket money to employ the Law Offices of Maloney & Campolo. You will never be asked for a retainer, or any expenses. Thus, you have nothing to lose financially by employing our firm to investigate your situation and provide you with our expert opinion on what your options may be.


Will your firm investigate my claim, without charge, and give me advice as to how I should proceed?
Absolutely. Many times, we literally invest thousands of dollars, only to tell our clients that we do not believe it is in their best interest to pursue the litigation. There is absolutely no charge whatsoever to employ us to investigate your claim and determine whether you should proceed with a lawsuit.


I don't live in Texas. Can you still represent me?
Yes, we have tried and arbitrated lawsuits all across the country. Recently we represented a young girl in a securities matter. She lived in Portland and the broker was based in Chicago, his attorneys were from Chicago and we are based in Texas. The case was mediated in Seattle! It was an outstanding resolution, resulting in several hundred thousand dollars of compensation for a very deserving client.

What damages am I entitled to under a Securities claim?
You are entitled to be reimbursed for those losses caused by your broker or investment advisor. These damages are calculated on the total amount of monies you have lost, as compared to what that sum of money would have earned if it would have been prudently invested in a well diversified portfolio. For example, let's say that you have lost $100,000.00 in the stock market. Your total losses are $100,000.00, yet the market declined 20% during that time frame. You are entitled to the difference between the $100,000.00 loss and the drop in the market resulting in compensation of $80,000.00. You must always keep in mind that your losses will be measured against what the stock market has done over the period of time that your broker has been giving you advice.
